This Privacy Policy (“Policy”) describes how Nivi, Inc. (“Nivi,” “we,” “our,” “us”) collects, uses, and discloses certain personal information obtained through our website (“Site”) located at https://www.asknivi.co.ke/ and our WhatsApp messaging service (“WhatsApp Service”), as well as information that we process as part of offering you our services (collectively with the Site, the “Services”). By using our Services, you consent to the terms of this Policy.
WHAT INFORMATION DO WE COLLECT AND MAINTAIN?
Our website visitors
We collect personal and other information from you directly when you provide it to us through the website. We also automatically collect certain information about you and your computer, smartphone, or other device when you use, access, or interact with our Site. We may also collect information from third parties in relation to providing you our Services.
You can visit the Site without submitting any information that we can use to identify you personally. However, to use certain features on the Site, such as the “Contact Us” feature, you will be required to provide personal information including your name, email address, and name of your organization, among other details needed about your organization.
Web log data
When you use the Site, we automatically receive and record certain information from your computer (or other device) and your browser. This may include such data as your IP address and domain name, the pages you visit on the Site, the date and time of your visit, the files that you download, the URLs from the websites you visit before and after navigating to the Site, your software and hardware attributes (including device IDs), your general geographic location (e.g., your city, state, or metropolitan region), and certain cookie information (see below). To obtain such information, we may use web logs or applications that recognize your computer and gather information about its online activity.
Cookies
We use cookies on the Site. Cookies are small files that are stored on your computer by your web browser. A cookie allows the Site to recognize whether you have visited before and may store user preferences and other information. For example, cookies can be used to collect or store information about your use of the Site during your current session and over time (including the pages you view and the files you download), your computer’s operating system and browser type, your Internet service provider, your domain name and IP address, your general geographic location, the website that you visited before visiting the Site, and the link you used to leave the Site. Web beacons
The Site may use an application known as a “web beacon” (also known as a “clear gif” or “web bug”). A web beacon is an electronic file that usually consists of a single-pixel image. It can be embedded in a web page or in an email to transmit information, which could include personal information. For example, it can allow an email sender to determine whether a user has opened a particular email.
Third-party online tracking and behavioral advertising
We may partner with certain third parties to collect, analyze, and use the personal and other information described in this section. For example, we may allow third parties to set cookies or use web beacons on the Site. This information may be used for a variety of purposes, including online interest-based advertising, as discussed below.
WhatsApp Service
When you call or text Nivi, or interact with our social media messaging services, we maintain a log of the information you provide that is associated with your WhatsApp phone number. That could include your phone number, social media handle, language preference, gender, age, location, personal health issues, and any other information you share with us in the course of using the WhatsApp Service.
Please note that WhatsApp may also process your information as part of engaging with our WhatsApp Service. That information is not governed by this Policy.
HOW DO WE USE AND PROCESS THIS INFORMATION?
Our legal bases for processing your personal information are: 1) your informed consent, which is freely given and can be withdrawn at any time; 2) performance and fulfillment of our contracts; and 3) a few limited legitimate uses such as compliance with law and court orders and public safety matters.
We use the information that we collect for a variety of purposes. We use this information to run our core operations, which is to provide you with health information, manage referrals, and solicit feedback on your experience with Nivi and its partners. We may also use some of the information for research and analytics purposes, including benchmarking for our partners and improving our artificial intelligence and machine learning Any information used for research and analytics products that are published and/or shared externally involve only anonymized or aggregated information. Such aggregated information will not identify you personally.
HOW DO WE DISCLOSE YOUR INFORMATION?
We may share any of the information described in “What Information Does Nivi Collect and Maintain?” above, with other parties for the set of purposes described below.
Third-party service providers
Nivi uses third-party service providers that perform services on our behalf, including web-hosting companies and analytics providers. These service providers may collect and/or use your information, including information that identifies you personally, to assist us in achieving the purposes discussed above.
We may share your information with other third parties when necessary to respond to your outreach via the Contact Us page and to meet the terms of any agreement that you have with us or our partners.
Analytics
We partner with certain third parties to obtain the automatically collected information discussed above and to engage in analysis, auditing, research, and reporting. These third parties may use web logs or web beacons, and they may set and access cookies on your computer or other device. In particular, the Site uses Google Analytics to help collect and analyze certain information for the purposes discussed above. You may opt out of the use of cookies by Google Analytics here.
Interest-based advertising
The Services enable third-party tracking mechanisms to collect information about you and your computing devices for use in online interest-based advertising. For example, third parties may use the fact that you visited our website to target online ads to you. In addition, our third-party advertising networks might use information about your use of our website to help target advertisements based on your online activity in general. The use of online tracking mechanisms by third parties is subject to those third parties’ own privacy policies, and not this Policy. Additionally, you may remove yourself from the targeted advertising of companies within the Network Advertising Initiative by opting out here, or for companies participating in the Digital Advertising Alliance by downloading their WebChoices or AppChoices tools here.
If you use the website through your mobile device, you may also opt out of interest-based advertising by adjusting the advertising preferences on your mobile device (for example, in iOS, visit Settings > Privacy > Advertising > Limit Ad Tracking, and in Android, visit Settings > Google > Ads > Opt out of interest-based ads).
Although our website currently does not respond to “do not track” browser headers, you can limit tracking through these third-party programs and by taking the other steps discussed above.
Business Transfers. Nivi, Inc. may sell, transfer or otherwise share some or all of its assets in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy.
WhatsApp Service
We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. We only share anonymized information unless you give us permission to do otherwise. Situations where we share your personally identifiable information are: 1) with health facilities when you redeem a referral code. We do not share any information about you with these facility partners unless and until you decide to visit the facility and redeem a referral code, and 2) with providers to schedule an appointment when you provide consent for us to share your information.

Prior to complying with your request, we will first verify your identity by comparing the information you provide with the information we have on file for you.
Please note that Nivi may not always be able to comply with the request of erasure for specific legal and regulatory reasons which will be notified to the user, if applicable, at the time of the request.
YOUR CONSENT
By visiting our Services, you freely provide consent for Nivi to collect, maintain, and process the personal information that you provide to us and any other uses of our services, and agree to abide by our Terms of Service. . As explained above in the “How do we use and process your personal information,” your personal information will be used to provide health information, manage referrals, and solicit feedback through the Nivi WhatsApp chatbot. COMPLIANCE WITH LAWS AND LAW ENFORCEMENT
Nivi, Inc. cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to protect the property and rights of Nivi or a third party, to protect the safety of the public or any person, or to prevent or stop any illegal, unethical or legally actionable activity.
CHILDREN’S PRIVACY
We created Nivi to serve adolescents and adults who are at least 15 years of age. We do not knowingly collect any information from anyone under 15 years of age.
DATA SECURITY AND RETENTION
Nivi uses reasonable security practices and procedures, including managerial, technical, operational, and physical safeguards, to protect your personal information. However, no website is 100% secure, and we cannot ensure or warrant the security of any information you transmit to the Site or to us, and you transmit such information at your own risk. We retain your personal information for as long as is necessary to provide the Nivi services or up to three (3) years, whichever date is earlier. When we destroy your personal information, we do so in a way that prevents that information from being restored or reconstructed.
INTERNATIONAL USERS
The information that we collect through or in connection with the Services is transferred to and processed in Germany for the purposes described above. Nivi may subcontract the processing of your data to, or otherwise share your data with, affiliates or third parties in countries other than your country of residence. The data protection laws in these countries may be different from your country of residence. By using the Services or by providing any personal or other information to us, you expressly consent to such transfer and processing.
